Keysight Terms and Conditions - Spain

Applies to quotes issued by and orders booked with Keysight Technologies Sales Spain, S.L.U.

Terms referenced and documents attached to the Keysight quotation apply to your purchase of hardware products, services and license to software (“Items”). Keysight Terms of Sale also apply to purchase of Item(s) unless the Item(s) falls under one or more of the following conditions:

• Repair, maintenance, and support services purchased subsequent to your purchase of Keysight Items or third party Items, Keysight Terms of Service shall apply
• Items with "(SOLN)" in the product description, Keysight Terms of Sale for Solutions shall apply.
• Items described in the quotation as KeysightCare, Basic/Essential/Enterprise or Silver/Gold/Platinum Support, Keysight Terms of Sale and KeysightCare, Basic/Essential/Enterprise and Silver/Gold/Platinum – Support Terms and Conditions shall apply.
• For Items with ESI in the product description, Computer Aided Engineering (ESI) Software Support and Maintenance Terms shall apply.
• For items with ODE or PowerArtist in the product description, Support and Maintenance Terms for Optical Design Engineering Software Products and PowerArtist shall apply.
• Items manufactured, modified or adapted by Keysight to meet your requirements as defined in a Statement of Work (SOW), Keysight Terms of Sale for Custom Products shall apply.
• Used Items purchased in response to a bid made by you in an auction offered by Keysight, Keysight Terms of Sale for Remarketed Products shall apply.
• Self-paced training modules purchased for electronic delivery and Keysight hosted training delivered through the web or in person at a Keysight facility, eLearning and Keysight Hosted Training Exhibit and Keysight Terms of Service shall apply.
• Training delivered by a Keysight instructor at your facility and consulting services, Keysight Consulting Services Terms and Conditions shall apply.
• Purchases receiving credit under Keysight’s Trade-up Program, Keysight Trade-Up Program Terms and Conditions shall apply as a supplement to the terms and conditions that apply as indicated above.
  
• Purchases of education and training, Keysight Customer Education and Training Terms shall apply.
• For Items with Eggplant in the product description, Keysight Terms of Sale for Eggplant Software Licenses and Services shall apply.
  
• Items described in the quote as On-Premises, Cloud or SaaS, the Keysight On-Premises, Cloud (SaaS), and Services Terms and Conditions shall apply.

Los Términos referidos en la oferta de Keysight y los documentos anexos a la misma, aplican a su compra de productos de hardware, servicios y licencias de software (“Ítems”). Los Términos y Condiciones de Venta de Keysight también se aplican a la compra de los Ítems, a menos que dichos Ítems estén bajo una o más de las siguientes condiciones:

• Los servicios de reparación, mantenimiento y soporte adquiridos después de la compra de productos/servicios de la marca Keysight o de terceros se regirán por los Términos y Condiciones de Servicio de Keysight.
• Los Ítems con la palabra “Solución/es” en su descripción se regirán por los Términos y Condiciones de Venta de Soluciones de Keysight.
• Los “Términos de Venta de Keysight”, los “Términos de KeysightCare” y los “Términos y Condiciones de Soporte de KeysightCare, Básico/Esencial/Empresarial y Plata/Oro/Platino (Basic/Essential/Enterprise y Silver/Gold/Platinum)” se aplican a los ítems descritos en la cotización como “Soporte de KeysightCare”, “Soporte Básico/Esencial/Empresarial (Basic/Essential/Enterprise)” o “Soporte Plata/Oro/Platino (Silver/Gold/Platinum)”.
• Los Ítems con “ESI” en la descripción del producto se regirán por los Términos de Soporte y Mantenimiento de Software de Ingeniería Asistida por Computadora (ESI).
• Los Ítems con “ODE” o “PowerArtist” en la descripción del producto se regirán por los Términos de Soporte y Mantenimiento para Productos de Software de Ingeniería de Diseño Óptico y PowerArtist.
• Los Ítems manufacturados, modificados o adaptados por Keysight para cumplir con los requerimientos descritos en un Plan de Trabajo (SOW) se regirán por los Términos y Condiciones de Venta de Productos Personalizados de Keysight.
• Los Ítems usados adquiridos en respuesta a una oferta realizada por usted en una subasta ofrecida por Keysight se regirán por los Términos de Venta de Keysight para Productos Reacondicionados.
• Los módulos de formación a su propio ritmo adquiridos para entrega electrónica y la formación impartida por Keysight a través de la web o de forma presencial en las instalaciones de Keysight se regirán por el Anexo de eLearning y Formación Impartida por Keysight y los Términos de Servicio de Keysight.
• La formación impartida por un instructor de Keysight en sus instalaciones y los servicios de consultoría se regirán por los Términos y Condiciones de Servicios de Consultoría de Keysight.
• Las compras sujetas al Programa de Sustitución de Productos Usados de Keysight se regirán por los Términos y Condiciones del Programa de Sustitución de Productos Usados de Keysight, adicionalmente a los Términos y Condiciones anteriormente mencionados, que sean aplicables.
  
• Los Cursos de Formación se regirán por los Términos y Condiciones de Keysight relativos a la Formación del Cliente.
• Los Ítems con “Eggplant” en la descripción del producto se regirán por los Términos de Venta de Keysight para Licencias de Software y Servicios de Eggplant.
• Los ítems descritos en la oferta como On-Premises, Cloud o SaaS, se regirán por los Keysight On-Premises, Cloud (Saas), and Services Terms and Conditions.
