Keysight Terms and Conditions - United States

Applies to quotes issued by and orders booked with Keysight Technologies Inc.

Terms referenced and documents attached to the Keysight quotation apply to your purchase of hardware products, services and license to software (“Items”). Keysight Terms of Sale also apply to purchase of Item(s) unless the Item(s) falls under one or more of the following conditions:

• Repair, maintenance, and support services purchased subsequent to your purchase of Keysight Items or third party Items (but, excluding Ixia branded Items), Keysight Service Terms shall apply.
• Items with "(SOLN)" in the product description, Keysight Terms of Sale for Solutions shall apply.
• Items described in the quotation as KeysightCare Support, Keysight Terms of Sale and KeysightCare Terms shall apply.
• Items described in the quotation as “renewal,” “maintenance,” “warranty,” “professional services,” or “technical support” related to Ixia branded products, Keysight Terms of Sale and Limited Warranty and Technical Support Agreement for Ixia Branded Keysight Products shall apply.
• Items manufactured, modified or adapted by Keysight to meet your requirements as defined in a Statement of Work (SOW), Keysight Terms of Sale for Custom Products shall apply.
• Items purchased under GSA Contract GS-07F-280AA, terms of GS07F280AA shall apply. If you are not a United States Federal Agency, you must have a valid letter of authorization on file with Keysight prior to order placement.
• Used Items purchased in response to a bid made by you in an auction offered by Keysight, Keysight Terms of Sale for Remarketed Products shall apply.
• Self-paced training modules purchased for electronic delivery and Keysight hosted training delivered through the web or in person at a Keysight facility, eLearning and Keysight Hosted Training Exhibit and Keysight Service Terms shall apply.
• Training delivered by a Keysight instructor at your facility and consulting services, Keysight Consulting Services Terms and Conditions shall apply.
• Items purchased under Keysight’s Instant Buy Program, Keysight Instant Buy Terms of Sale shall apply.
• Purchases receiving credit under Keysight’s Trade-up Program, Keysight Trade-Up Program Terms and Conditions shall apply as a supplement to the terms and conditions that apply as indicated above.
• Items purchased for resale where you are not an authorized Keysight Channel Partner, Keysight Terms of Sale for Resale shall apply.
• Items in Keysight’s Network Test product line rented directly from Keysight, Keysight Rental Terms and Conditions shall apply.
• Items described in the quote as On-Premises or SaaS, the Keysight On-Premises, SaaS, and Services Terms and Conditions shall apply.
• Items described in the quote as BreakingPoint Cloud, CloudCentral, CloudLens and Hawkeye Express, the ISG SaaS Terms of Service shall apply.

Los Términos referidos en la Cotización de Keysight y los documentos anexos a la misma, aplican a su compra de productos de hardware, servicios y licencias de software (“items”). Los Keysight Terms of Sale también se aplican a la compra de los items, a menos que dichos items estén bajo una o más de las siguientes condiciones:

• Los servicios de reparación, mantenimiento y soporte adquiridos después de su compra de productos/servicios de la Marca Keysight o de terceros (excluyendo los productos/servicios con la Marca Ixia) se regirán por los Keysight Service Terms.
• Los Ítems con la palabra “Solución/es” en su descripción, se regirán por los Keysight Terms of Sale for Solutions.
• Los “Términos de Venta de Keysight” y los “Términos de KeysightCare” se aplican a los ítems descritos en la cotización como “Soporte de KeysightCare”.
• Los Ítems descritos en la cotización como "renovación", "mantenimiento", "garantía", “servicios profesionales” o "soporte técnico" relacionados con los productos/servicios etiquetados con la Marca Ixia, se regirán por los Keysight Terms of Sale y por Limited Warranty and Technical Support Agreement for Ixia Branded Keysight Products.
• Los Ítems manufacturados, modificados o adaptados por Keysight para cumplir con los requerimientos descritos en un Estatuto de Trabajo (SOW), se regirán por los Keysight Terms of Sale for Custom Products.
• Los ítems adquiridos bajo el Contrato “GSA Contract GS-07F-280AA”, se regirán por los Términos de dicho Contrato. Si Usted no es una Agencia Federal de los Estados Unidos de América, entonces deberá tener una carta de autorización vigente con Keysight antes de colocar su orden de compra.
• La Compra de Productos Usados, derivada de una oferta presentada por Usted en respuesta a una subasta abierta por Keysight, se regirá por los Keysight Terms of Sale for Remarketed Products.
• Los Módulos de capacitación auto-dirigidos adquiridos y provistos electrónicamente y la capacitación patrocinada por Keysight e impartida a través de internet o en forma presencial en un establecimiento de Keysight, se regirán por Keysight Service Terms y por el eLearning and Keysight Hosted Training Exhibit.
• La capacitación proporcionada por un instructor de Keysight en el local del Cliente y los Servicios de Consultoría, se regirán por los Keysight Consulting Services Terms and Conditions.
• Los ítems adquiridos bajo el Programa de Keysight “Instant Buy”, se regirán por los Keysight Instant Buy Terms of Sale.
• Las Compras sujetas al Programa de Sustitución de Productos Usados de Keysight, se regirán por los Keysight Trade-Up Program Terms and Conditions, que sean aplicables.
• Los ítems adquiridos para ser revendidos por una entidad que no es un Canal de Venta Autorizado de Keysight , se regirán por los Keysight Terms of Sale for Resale.
• Los ítems de la línea de productos de prueba de redes de Keysight rentados directamente de Keysight, se regirán por los Keysight Rental Terms and Conditions.
• Los ítems descritos en la cotización como On-Premises o SaaS, se regirán por los Keysight On-Premises, SaaS, and Services Terms and Conditions.
• Los Ítems descritos en la cotización como BreakingPoint Cloud, CloudCentral, CloudLens y Hawkeye Express, se regirán por los ISG SaaS Terms of Service.
